FOUR MONTHS!!! What a concept! It took us 2 1/2 years post tbi to get SSDI. The first 2 steps we were rejected outright with the explanation that Kathy has seizures and they are controlled by medication. The intellectual giant looking at the file didn't even read it to see why we were applying. The appeal (back to the same genius) is a ten day period where you are given notice of appeal and have ten days to give additional information. I received the letter on the eleventh day!

Fourteen months later we finally went to federal court for a hearing. We were there for five minutes and it was granted. Somebody actually read the file beforehand. Incidentally, on the way out, the judge asked if there was a malpractice suit occurring, apparently judges don't ask that because our lawyer was stunned.

It's done, and we should be receiving all the back money eventually. By the way, if there are minor children involved, they are entitled to up to half again the recipients monthly amount. It is based on a sliding scale.
